先聲明我是龜仔一派的,
我跟男友因為這個問題爭吵不休,
乾脆直接寄信給高公局局長信箱,
用情境式問題提問,
1. 當我以最高限速行駛於內側車道時,如後車閃爍車燈 (必定超速不一定到開罰車速),我
需要禮讓後車嗎?
2. 當我以最高限速加10,造成超速但情節輕微不予開罰的狀態行駛於內側車道時,如後車
閃爍車燈 (必定超速),我需要禮讓後車嗎?
3. 內側車道的路權是以限速或是超車為優先?

今天收到了回覆(亂碼是本來就是亂碼
一、 臺端110年11月23日致本局局長信箱編號FWM1101123001電子郵件敬悉。
二、 依「高速公路及快速公路交通管制規則」第8條第1項第3款規定:「內側車道為超?
。但小型車於不堵塞行車之狀況下,得以該路段容許之最高速限行駛於內側車道」即車輛於
內側車道超車後原則應駛回原本車道,惟考量高速公路車流量大 A部分路段於尖峰時段交
通量需求已接近或逾道路容量,故開放小型車在不堵塞行車之狀況下,得以最高速限行駛於
內側車道,期在於不影響內側車道之超車功能下,提高車道使用效率。
三、 依前述規定,小型車於不堵塞行車之狀況下,方得以最高速限持續行駛於內側車道
爰以最高速限行駛於內側車道之小型車,無論後方有無車輛靠近,為免堵塞行車及考量表速
誤差,仍建議在有安全距離情形下駛回原車道為宜;至於前車若未禮讓是否視為堵塞行車,
則由員警依現場情況認定。
四、 為避免爭議及維持內側車道超車道功能及車流順暢,本局亦持續透過CMS、廣播、?
媒體、宣導短片、懸掛紅布條等各種管道,並在 u線多處設置內側車道為超車道之標誌,
加強宣導用路人於超車後儘量勿占用內側車道。

其中關於第二點我有點疑惑,
所以是在什麼時後開放在不阻塞行車的狀況下得以最高限速行駛於內車道?
我看完覺得好像是交通高峰才開放,
又怕我中文閱讀障礙 = =
